2. Who these Terms apply to Tank Site is provided for business use only. By using Tank Site, you confirm that: You are acting on behalf of a business or organisation You have authority to bind that organisation to these Terms You are at least 18 years old Tank Site is not intended for consumer or personal use.
3. The Tank Site service Tank Site is an industrial tank monitoring platform that: Collects sensor data from local systems (including analogue input modules, IO-Link masters and OPC tags) Converts sensor readings into volumetric tank level and contents data Displays and logs data locally at a customer site Transmits selected data to an online platform for sharing with authorised users Provides alerting functionality (low, high, rapid drop) Sends alert notifications by email and dashboard notifications Allows users to acknowledge alerts and notify tank owners Tank Site consists of: Local software running on customer-owned hardware An online platform used for data sharing and alerting
4. Accounts and access Access to Tank Site requires a registered account and a valid licence. One user email address is registered per company. You are responsible for keeping your login credentials secure. You must ensure all users comply with these Terms. We may suspend or terminate access if: These Terms are breached The service is misused A licence expires or is revoked We are required to do so by law
5. Licensing, payment and renewal Tank Site is provided under a licence-based model. Licences are billed annually. No refunds are offered once a licence has been issued. Licences do not auto-renew unless otherwise agreed in writing. Access to the service may be limited or suspended if a licence expires.
6. Alerts, notifications and emails Tank Site sends: Service emails (mandatory) Alert emails (user-configured) Marketing emails (optional) You may opt out of marketing emails at any time. Service and alert emails are essential to the operation of the platform and cannot be fully disabled where alerts are enabled. We do not guarantee delivery time or receipt of emails.
7. Use restrictions You must not: Use Tank Site for safety-critical or life-critical purposes Rely on the platform as the sole means of monitoring hazardous systems Reverse engineer, modify, or interfere with the software Use the service in a way that is unlawful or harmful Tank Site must not be used as a replacement for safety systems, alarms required by law, or physical safeguards.
8. Hardware control disclaimer Tank Site may control outputs such as lights, beacons or sounders. You acknowledge that: Hardware integration is your responsibility Outputs are provided for indication only The system is not designed for safety-critical control You are responsible for ensuring all installations comply with applicable regulations
9. Availability and changes We aim to provide a reliable service but do not guarantee uninterrupted availability. We may: Update or modify features Temporarily suspend access for maintenance Change these Terms from time to time Updated Terms will be made available via the platform.
10. Intellectual property All intellectual property in Tank Site remains the property of Metrics Industrial Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the service during the licence term.
11. Liability limitations To the maximum extent permitted by law: We are not liable for indirect, incidental or consequential loss We are not liable for loss of profit, data, business, or opportunity We are not liable for sensor inaccuracies, communication failures, or delayed alerts Total liability is limited to the fees paid in the preceding 12 months Nothing in these Terms excludes liability for death or personal injury caused by negligence.
12. Termination Either party may terminate access if the other materially breaches these Terms. Upon termination: Access to the platform will cease Licences are not refunded Clauses intended to survive termination shall continue to apply
13. Governing law These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
